SubTitle 3. AMUSEMENT HALLS AND ROLLER SKATING RINKS |
§ 21-4-304. LICENSE DENIAL, REFUSAL TO RENEW, REVOCATION, OR SUSPENSION - AUTHORITY OF THE DIRECTOR.
(a)
"Licensee" defined. In this section, "licensee" includes the operators, agents, or employees of a licensed amusement hall or roller skating rink.
(b)
Grounds.
(1)
The Director may deny a license to an applicant, refuse to renew, revoke, or suspend a license issued under this subtitle if the applicant or licensee:
(i)
Fraudulently or deceptively obtains or attempts to a obtain a license for the applicant or licensee or for another person;
(ii)
Fraudulently or deceptively uses a license;
(iii)
Violates this subtitle;
(iv)
Violates a regulation adopted under this subtitle;
(v)
Fails to correct a violation in accordance with a final order issued under Article 3, Title 6 of the Code; or
(vi)
Refuses to allow an inspection of the facility as required under § 21-4-308 of this subtitle.
(2)
In addition to the criteria in paragraph (1) of this subsection, the Director may revoke or refuse to renew a license if the licensee fails to:
(i)
Comply with all applicable state and county law, regulations, and standards, including compliance with:
1.
All codes as defined in Article 3, Title 6 of the Code;
2.
Health regulations and standards; and
3.
Any applicable restrictions on the hours of operation;
(ii)
Prevent excessive noise, traffic congestion, vandalism, or other activities on or about the premises which may constitute a nuisance or which lead to the arrest or detention of patrons, business invitees, or guests of the licensed facility; or
(iii)
If the licensee knew of or condoned these activities or offenses, prevent on or about the premises:
1.
Crimes of violence;
2.
Sex offenses;
3.
Prostitution or solicitation;
4.
Drunkenness;
5.
Lewdness;
6.
Contributing to the delinquency of a minor;
7.
Violations of gaming, alcoholic beverages, or controlled dangerous substances laws; or
8.
Other similar offenses and activities.
