§ 32-3-509. EXEMPTION FROM CYCLICAL SCHEDULE.

  • (a)

    In general. A petition shall be exempted from the regular, cyclical schedule under § 32-3-504 of this subtitle and also from the suspension of reclassification petition filing under § 32-3-516 of this subtitle if:

    (1)

    The Planning Board certifies to the County Council that early action on a zoning reclassification petition is manifestly required in the public interest or because of an emergency; and

    (2)

    The County Council approves the certification.

    (b)

    Scheduling of hearing. The Board of Appeals shall schedule a public hearing for a date not less than 30 days and not more than 90 days after the County Council's certification to exempt the petition from the cyclical hearing schedule.

    (c)

    Notice.

    (1)

    The Department of Permits, Approvals and Inspections shall:

    (i)

    Require a notice of the hearing, with notice of the time and place of the hearing, to be posted conspicuously on the property that is the subject of the hearing for a period of at least 15 days before the time of the hearing; and

    (ii)

    Require a notice of the hearing to be placed one time in two newspapers of general circulation in the county at least 15 days before the hearing.

    (2)

    The notice shall describe the property under petition and the action requested by the petition.

    (d)

    Reports by other agencies. Within 5 days after receipt of a petition under this section, the Department of Permits, Approvals and Inspections shall forward a copy of the petition for consideration and a written report containing findings on the petition with regard to compliance with Baltimore County Zoning Regulations, planning factors, or Chesapeake Bay Critical Area standards, subject to § 32-3-224 of this title and Title 9 of this article to:

    (1)

    The Director of Planning; and

    (2)

    In the case of a petition pertaining to any land within the Chesapeake Bay Critical Area, to the Director of Environmental Protection and Sustainability.
