§ 32-3-504. SCHEDULE OF CYCLES AND PERIODS.

(a)

In general; cycles. For the purpose of considering contemporaneous zoning reclassification petitions in relation to each other, the Board of Appeals shall consider the petitions during one of the following cycles:

(1)

Cycle 1, which begins on April 16 in the year following the comprehensive quadrennial zoning map process;

(2)

Cycle 2, which begins on October 16 in the year following the comprehensive quadrennial zoning map process;

(3)

Cycle 3, which begins on April 16 two years after the comprehensive quadrennial zoning map process;

(4)

Cycle 4, which begins on October 16, two years after the comprehensive quadrennial zoning map process; or

(5)

Cycle 5, which begins on April 1 three years after the comprehensive zoning map process.

(b)

Periods in each cycle.

(1)

For cycles that begin in April:

(i)

Period I begins April 16 and ends May 31;

(ii)

Period II begins June 1 and ends July 31;

(iii)

Period III begins August 1 and ends August 31; and

(iv)

Period IV begins September 1 and ends December 31.

(2)

For cycles that begin in October:

(i)

Period I begins October 16 and ends November 30;

(ii)

Period II begins December 1 and ends January 31;

(iii)

Period III begins February 1 and ends on the last day of February; and

(iv)

Period IV begins on March 1 and ends on June 30.

(c)

Petition filing deadline. The owner or the owner's representative shall file the petition no later than 45 days before the beginning of the cycle.
