§ 25-1-107. ENFORCEMENT REMEDIES.

  • (a)

    Remedies. Except in the case of customer service and consumer protection violations under Title 3, Subtitle 2 of this article, if a franchisee violates a material provision of this article or the franchise agreement, the County Council may take one or more of the following actions:

    (1)

    Impose monetary damages of up to $100 per day for each day that a violation occurs;

    (2)

    Revoke the franchise in accordance with § 25-2-108 of this article; or

    (3)

    Seek legal or equitable relief from a court of competent jurisdiction.

    (b)

    Continuing obligation. Payment of monetary damages does not relieve the franchisee of its obligation to comply with franchise requirements.
