§ 25-1-106. FRANCHISEE SUBJECT TO OTHER LAWS; COMPLIANCE WITH ARTICLE.

  • (a)

    Subject to other laws and police power.

    (1)

    A franchisee is subject to applicable county laws and the nondiscriminatory exercise of police power by the county, provided that each of these authorities is consistent with a franchisee's rights under a franchise agreement.

    (2)

    A franchisee shall comply with all other applicable laws, including federal and state laws and regulations governing cable communications.

    (b)

    Duty to comply regardless of enforcement. A franchisee shall comply with the terms and conditions of this article or a franchise agreement notwithstanding any failure or negligence of the county to require compliance or performance under this article or the franchise agreement.
