§ 21-4-204. LICENSE REQUIRED.

  • (a)

    Application of section. This section applies to the proprietor or person who possesses a coin-operated amusement device for the purpose of operation by the public.

    (b)

    Application for a license. The proprietor or possessor of a coin-operated amusement device shall apply for and receive a license for each coin-operated amusement device before it may be operated by the public.

    (c)

    Form and content of the license application. A person required by this section to apply for and receive a license shall apply for the license on a form required by the Director which shall include:

    (1)

    The name and address of the licensee and owner;

    (2)

    The location of the coin-operated amusement device; and

    (3)

    A description of the coin-operated amusement device.

    (d)

    Disposition of the license.

    (1)

    The licensee shall firmly attach the license to the appropriate coin-operated amusement device or prominently display the license on the premises.

    (2)

    The licensee may not transfer the license to another coin-operated amusement device.

    (3)

    (i)

    On payment of the appropriate fee and approval of the Director, a licensee may transfer a licensed coin-operated amusement device to another location.

    (ii)

    The Director shall note the change on the license.

    (e)

    Zoning approval. The licensee shall prominently display on the premises a certificate indicating the total number of coin-operated amusement devices authorized by the Department to be on the premises.
