Title 16. TOWING BUSINESSES |
§ 21-16-105. QUALIFICATIONS.
(a)
In general . The Department may not issue or renew a license under this title unless the applicant or licensee complies with the provisions of this section.
(b)
Storage facilities . The applicant or licensee shall:
(1)
Provide secure fenced-in storage facilities either on the premises shown on the license or within sight of the premises shown on the license, including:
(i)
Capacity for ten or more vehicles for a trespass towing licensee; and
(ii)
Capacity for 30 or more vehicles for a police-initiated towing licensee; and
(2)
Dispatch towing vehicles either from the premises shown on the license or from the fenced-in storage facilities.
(c)
Zoning and building compliance . The storage facilities shall comply with the zoning regulations and the fencing requirements of the county in which the tower is located.
(d)
Insurance coverage . The applicant or licensee shall give evidence to the county of comprehensive general liability insurance coverage in a company licensed to do business in the state in the minimum amounts of $100,000 per individual, $300,000 per occurrence, and $100,000 property damage on each vehicle.
