§ 20-5-122. CONFIDENTIAL INFORMATION.

  • Information and data on a user obtained from reports, questionnaires, permit applications, permits and monitoring programs, and from inspections shall not be made available to the public, but may be made available upon written request to governmental agencies for uses related to this title, the National Pollutant Discharge Elimination System (NPDES) permit, state disposal system permit, and the pretreatment programs; provided, however, that such information shall be available for use by the state or county in any judicial or quasi-judicial review or enforcement proceedings involving the user. Wastewater constituents and characteristics shall not be recognized as confidential information. Information accepted by the Engineer as confidential shall not be transmitted to any governmental agency by the Engineer until and unless a ten-day notification is given to the user.
