§ 20-5-121. INSPECTION; RIGHT OF ENTRY.

  • (a)

    The Engineer or his authorized representative shall have the right, at reasonable times, of entry to, upon, or through any premises discharging industrial wastewater or applying for a permit to discharge industrial wastewater to the system for the purpose of determining compliance with this title and any permit issued pursuant thereto and shall at reasonable times have access to and the right to copy any records required to be maintained, under this title or the permit.

    (b)

    The EPA, the state, and the county shall have the right to set up on any premises discharging industrial wastewater to the system such devices as are necessary to conduct sampling, inspection, compliance, monitoring, and metering operations.

    (c)

    Where an industrial user has security measures in force which would require proper identification and clearance before entry into their premises, the user shall make necessary arrangements with their security guards so that, upon presentation of suitable identification, personnel from the county, the state, and the EPA will be permitted to enter, without delay, for the purpose of performing their specific responsibilities.

    (d)

    While performing inspections, sampling, or related work, the Engineer or his authorized representative(s) shall observe all established safety rules to be supplied as part of the user's application for the wastewater discharge permit application.
