§ 13-7-301. DEFINITIONS.
(a)
In general. In this subtitle the following words have the meanings indicated.
(b)
Building.
(1)
"Building" means a public or private and occupied or unoccupied structure or dwelling that is devoted to, designed for, or used for:
(i)
Occupancy of any kind;
(ii)
The transaction of business of any nature;
(iii)
The rendering of professional services;
(iv)
Amusement;
(v)
The display, sale, or storage, of goods, wares, or merchandise; or
(vi)
The performance of work or labor.
(2)
"Building" includes a house, hotel, apartment building, rooming house, tenement house, office building, public building, store, theater, market, restaurant, grain elevator, abattoir, warehouse, workshop, factory, outhouse, shed, and barn.
(c)
County Health Officer. "County Health Officer" includes a designee of the County Health Officer.
(d)
Code Official. "Code Official" has the meaning stated in § 3-6-101 of the Code.
(e)
Occupant. "Occupant" means:
(1)
A person occupying a building or part of a building, whether as owner or tenant; or
(2)
The owner of a vacant building or any vacant portion of the building.
(f)
Owner.
(1)
"Owner" means:
(i)
The person who is the actual owner of the building; or
(ii)
The lessee of a building when, under the terms of a lease, the lessee is responsible for maintenance and repair.
(2)
"Owner" includes:
(i)
The agent for the actual owner of the building; and
(ii)
The custodian of the building.
(g)
Rat. "Rat" includes a mouse.
(h)
Rat eradication.
(1)
"Rat eradication" means the elimination or extermination of rats within and outside of a building and from a rat harborage of any kind by an accepted measure so that the building and rat harborage are completely free of rats and there is no evidence of rat infestation remaining.
(2)
"Rat eradication" includes baiting, fumigating, trapping, and clubbing.
(i)
Rat harborage.
(1)
"Rat harborage" means a condition that may constitute a normal and ordinary rat habitat conducive to their multiplication and continued existence in, under, or adjacent to a building.
(2)
"Rat harborage" includes burrows.
(j)
Rat-proof. "Rat-proof" means a building constructed in accordance with the provisions of the County Building Code to prevent the ingress of rats into the building from the exterior or from one building to another.
(k)
Rodent. "Rodent" includes rats and mice.
