§ 3-6-101. DEFINITIONS.

  • (a)

    In general. In this title the following words have the meanings indicated.

    (b)

    Code.

    (1)

    "Code" means the:

    (i)

    Building Code;

    (ii)

    Electric Code;

    (iii)

    Mechanical Code;

    (iv)

    Permits and licenses law and regulations;

    (v)

    Plumbing and Gasfitting Code;

    (vi)

    Livability Code;

    (vii)

    Fire Code;

    (viii)

    Zoning Regulations; and

    (ix)

    Any other code, regulation, or standard administered by the Department of Permits, Approvals and Inspections.

    (2)

    "Code" does not include the County Code.

    (c)

    Code enforcement. "Code enforcement" means the enforcement of a code or the County Code in accordance with this title.

    (d)

    Code Official. "Code Official" means the Director of Permits, Approvals and Inspections or the Director's designee.

    (e)

    County Code. "County Code" means the Baltimore County Code as it is designated under § 1-1-101 of the County Code and as it relates to:

    (1)

    Building;

    (2)

    Electric;

    (3)

    Permits and licenses;

    (4)

    Plumbing;

    (5)

    The Livability Code;

    (6)

    The Fire Code;

    (7)

    Zoning;

    (8)

    Stormwater management;

    (9)

    Excavations, grading, erosion and sediment control and forest management;

    (10)

    Chesapeake Bay Critical Area protection;

    (11)

    Protection of water quality, streams, wetlands and floodplains;

    (12)

    Forest conservation;

    (13)

    Removal of asbestos;

    (14)

    Food service facilities;

    (15)

    Sanitary requirements for boat marinas;

    (16)

    Public swimming pools and bathing beaches;

    (17)

    Nuisances;

    (18)

    Solid waste; and

    (19)

    Water and sewers.

    (f)

    Director. "Director" means the Director of Environmental Protection and Sustainability or the Director's designee.

    (g)

    Final order. "Final order" means :

    (1)

    The citation issued by the Code Official or the Director under § 3-6-205 of this title if the violator has not requested a code enforcement hearing in a timely fashion; or

    (2)

    An order issued by the hearing officer:

    (i)

    At the conclusion of a code enforcement hearing; or

    (ii)

    If the violator fails to appear at a requested code enforcement hearing.

    (h)

    Hearing Officer. "Hearing Officer" means the Office of Administrative Hearings.

    (i)

    Violation. "Violation" means the failure to comply with a provision of:

    (1)

    The County Code; or

    (2)

    A code.

    (j)

    Violator. "Violator" means the person charged with a violation.
