§ 13-7-127. SAME - APPEAL TO CIRCUIT COURT.
(a)
Right to appeal. A person who feels aggrieved by the order of the Council under § 13-7-126(b)(2) of this Part III of this subtitle may appeal the order to the Circuit Court of the county.
(b)
Time for the appeal; waiver.
(1)
The aggrieved person shall file the appeal within 15 days after the date of the Council's final order.
(2)
If the aggrieved person does not file the appeal within the 15-day time period, the aggrieved person is deemed to have waived the right to appeal.
(c)
Authority of the Court.
(1)
(i)
The Court may review the estimate of the county regarding the extent, if any, to which the appellant will be benefitted or damaged by the proposed plan.
(ii)
The Court's decision on this matter is final.
(2)
The Court may not review the decision of the county regarding the propriety of the proposed improvement or the proposed plan.
