§ 13-7-124. PROCEDURE WHEN THE SOURCE OF THE NUISANCE IS UNCERTAIN - APPLICATION.
For purposes of §§ 13-7-125 through 13-7-128 of this Part III of this subtitle, the source of a nuisance on a road is deemed to be uncertain if the results of the investigation required under this subtitle show that the source of the nuisance is:
(1)
Uncertain;
(2)
Contributed to by a large number of persons; or
(3)
The result of inadequate drainage or sewerage facilities at or near the point in question.
