§ 13-7-123. PROCEDURE WHEN THE SOURCE OF THE NUISANCE IS CERTAIN.

  • (a)

    Authority to require abatement. If the investigation required under this Part III of this subtitle determines that a nuisance on a road originated on lands adjoining or near to the road, the Director of Environmental Protection and Sustainability may enforce the provisions of this Part III in accordance with Article 3, Title 6 of the Code.

    (b)

    Penalty for failure to abate. An owner who fails to abate a nuisance within the time prescribed in the notice issued under subsection (a) of this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 for each day the nuisance continues after the expiration of the period prescribed by the notice.
