§ 7-1-310. EXEMPTIONS.
(a)
Commission power to exempt. The Ethics Commission may exempt a member or prospective member of a county board or commission from the provisions of this subtitle or modify the provisions of this subtitle for a member or prospective member of a county board or commission if, because of the nature of the board or commission, the Ethics Commission finds that:
(1)
The application of this subtitle to that board, commission, or member would:
(i)
Constitute an unreasonable invasion of privacy; or
(ii)
Reduce the availability of uniquely qualified individuals for public service; or
(2)
The exemption or modification is not contrary to the purposes of this subtitle.
(b)
Records of exemptions.
(1)
The Ethics Commission may grant an exemption or modification authorized under subsection (a) of this section only on the written request of the board, commission, member, or prospective member involved.
(2)
Notwithstanding any other provision of this title to the contrary, the records of the Ethics Commission in any matter in which an exemption or modification is granted shall be available for public inspection.
