Part II. MEDIATION, FACT-FINDING AND ARBITRATION PANEL |
§ 4-5-403. SAME - MEMBERSHIP.
(a)
Composition; appointment of members.
(1)
The Arbitration Panel consists of five members.
(2)
Of the five members of the Arbitration Panel:
(i)
Three shall be appointed by the County Council;
(ii)
One shall be appointed by the County Executive; and
(iii)
One shall be selected by the county employee's organizations.
(b)
Qualifications.
(1)
Of the three members appointed by the County Council:
(i)
One must have at least 10 years of experience in labor relations;
(ii)
One must have at least 10 years of professional experience in the management of budget and finance operations; and
(iii)
One must be a resident of the county.
(2)
A member of the Panel may not be:
(i)
A current or former employee of the county;
(ii)
A spouse or dependent family member of a current or former employee of the county; or
(iii)
A member of any of the county's employee organizations or parent organizations of the employee organizations.
(c)
Tenure; vacancies.
(1)
The term of a member is 4 years and begins on July 1.
(2)
The terms of members are staggered as required by the terms in effect for members of the Panel on November 19, 1998.
(3)
At the end of a term, a member continues to serve until a successor is appointed and qualifies.
(4)
In the event of a vacancy, a successor shall be appointed to fill the remainder of the member's term in accordance with this subsection.
(d)
Compensation. A member of the Panel shall serve without compensation.
(e)
Staff. The Panel shall be provided with staff support for the preparation of its recommendations under this Part II of this subtitle.

Annotation— Section 4 of Bill 112-98, effective November 20, 1998, states: "the initial members of the arbitration panel shall be appointed on or before March 1, 1999". The section also provides expiration dates for the terms of those initial members.
