§ 3-3-405. MISCELLANEOUS POWERS AND DUTIES.

  • (a)

    Powers in general. The Animal Hearing Board possesses all the powers and duties specified in this subtitle and Article 12 of the Code and all powers necessary to properly carry out the provisions of this subtitle and Article 12 of the Code.

    (b)

    Duties. The Animal Hearing Board shall:

    (1)

    (i)

    Adopt rules of procedure to govern the conduct of its hearings; and

    (ii)

    Make the rules readily available to the public;

    (2)

    Advise the County Executive or the Health Officer on all matters relating to the control and welfare of animals in the county, including:

    (i)

    Rules concerning the operation of the animal shelter operated by or under contract with the county;

    (ii)

    Standards for the collection, care, custody, and disposal of animals at large, public nuisance animals, and dangerous animals;

    (iii)

    Standards for the maintenance of holding facilities and the care of animals in holding facilities;

    (iv)

    The establishment of a permanent public education program;

    (v)

    The establishment of a program for the sterilization of dogs and cats in the county;

    (vi)

    The performance of the Animal Services Division in exercising all duties and powers authorized under Article 12 of the Code; and

    (vii)

    The annual budget for carrying out the provisions of this subtitle and Article 12 of the Code, including fees and penalties; and

    (3)

    Hear and decide all contested civil cases and all cases referred by the Health Officer concerning the enforcement of Article 12 of the Code.
