SubTitle 13. PERSONNEL AND SALARY ADVISORY BOARD |
§ 3-3-1305. MISCELLANEOUS DUTIES AND POWERS.
(a)
Duties. In addition to the duties required by the personnel rules, the Personnel and Salary Advisory Board shall:
(1)
Determine its own rules of procedure and the order of business for the conduct of its meetings;
(2)
Advise and consult with the County Executive, the County Administrative Officer, the Director of Human Resources, and other county officials and employees on matters concerning the administration of the county career service, the Charter, this subtitle, Article 4 of the Code, and the personnel rules;
(3)
Conduct investigations or inquiries regarding the administration of the county career service and advise the appropriate county officials of the Board's findings and recommendations;
(4)
Subject to the provisions of § 803 of the Charter:
(i)
Hear and decide appeals that are reviewable under Article 4 of the Code or the personnel rules that have been filed by merit system status employees who have been dismissed for cause or subjected to other disciplinary actions; and
(ii)
Review and decide appeals brought by applicants for jobs in the classified service in cases involving examinations and examination ratings;
(5)
Perform other duties requested by the County Executive or the County Administrative Officer; and
(6)
On or before January 31 of each year, issue a written report to the County Executive, and forward a copy to the County Council, discussing the administration of the county career service during the preceding year, and summarizing developments and progress made in meeting the objectives and purposes of Article VIII of the Charter and Article 4 of the Code.
(b)
Powers. The Board may:
(1)
Except for its duty to hear and decide appeals taken under subsection (a)(4) of this section, delegate to the Director of Human Resources any of its duties;
(2)
Request that the Office of Administrative Hearings:
(i)
Conduct a preliminary hearing regarding an appeal brought by a merit system status employee under subsection (a)(4) of this section; and
(ii)
Provide to the Board, in writing, recommended findings of fact and conclusions of law with respect to the appeal; and
(3)
In conducting investigations or inquiries authorized under subsection (a)(3) of this section:
(i)
Administer oaths;
(ii)
Compel the attendance of witnesses; and
(iii)
Require the production of records and other materials.
