§ 33-7-105. HEARING.

  • (a)

    Authorized. An opportunity for a hearing shall be provided if a written request is filed with the Department within 10 days following issuance of an order under this title.

    (b)

    Time and place. The Department shall conduct hearings at a time and place designated by the Department.

    (c)

    Disposition Based on the record of the hearing, the Department shall make a finding and shall sustain, modify, or rescind any order considered in the hearing.

    (d)

    Written report. The Department shall provide a written report of the hearing decision to the hearing applicant.

    (e)

    Appeal to the Board of Appeals.

    (1)

    A hearing applicant dissatisfied with the decision of the Department may appeal to the Board of Appeals by filing a written notice of appeal with the Department within 10 days after the decision.

    (2)

    (i)

    The notice of appeal shall contain a full statement of the grounds for appeal.

    (ii)

    The appeal shall be limited to the grounds stated.
