§ 33-5-302. INSPECTION AND ENFORCEMENT.

  • (a)

    Department of Permits, Approvals and Inspections responsibility.

    (1)

    The Department of Permits, Approvals and Inspections is responsible for:

    (i)

    Enforcement of this title and approved plans and permits; and

    (ii)

    Field inspection of grading and erosion and sediment control measures and devices.

    (2)

    The Department also shall inspect erosion and sediment control measures and devices installed on all county capital improvement projects and public works maintenance projects.

    (b)

    Modification of plans.

    (1)

    Modifications to an approved erosion and sediment control plan may be requested by the owner/developer or required by the District or the Department of Permits, Approvals and Inspections.

    (2)

    Modifications shall be made in accordance with the erosion and sediment control criteria contained in the Handbook and the criteria for major and minor modifications as provided in this subsection.

    (3)

    (i)

    Major modifications include:

    1.

    Revisions to sediment control practices involving concentrated flow or impoundments, such as a sediment basin or traps; or

    2.

    Significant changes to the sequence of construction or to the phasing of grading units.

    (ii)

    Major modifications must be approved by the District before implementation.

    (4)

    (i)

    In conjunction with the Department of Permits, Approvals and Inspections, the District may develop a list of minor modifications.

    (ii)

    The administration shall review and approve all minor modification lists.

    (iii)

    The Department of Permits, Approvals and Inspections may allow the implementation of minor modifications as field revisions.

    (iv)

    The Department of Permits, Approvals and Inspections shall approve field revisions in writing before their implementation.

    (c)

    Times for inspections. Inspections shall be conducted in accordance with inspection procedures established by the Department at the following stages of operation:

    (1)

    During initial clearing and grading of the site;

    (2)

    On completion of the installation of the principal erosion and sediment control measures;

    (3)

    Periodically, during the course of the grading or construction activity, or both;

    (4)

    Before removal of the erosion and sediment control measures; and

    (5)

    After final stabilization of the entire site.

    (d)

    Time for building construction. Building construction may not be started until all principal erosion and sediment control measures are installed in accordance with the approved plans and inspected by the Department.

    (e)

    Inspection; report of inspection.

    (1)

    The owner or developer shall maintain a copy of the approved erosion and sediment control plan on site.

    (2)

    Every active site having a designed erosion and sediment control plan shall be inspected for compliance with the plan on average once every two weeks.

    (3)

    The Department shall prepare a written report after every inspection that shall include:

    (i)

    The date and location of the site inspection;

    (ii)

    Whether the approved plan has been properly implemented and maintained;

    (iii)

    Practice deficiencies or erosion and sediment control plan deficiencies;

    (iv)

    If a violation exists, the type of enforcement action taken; and

    (v)

    If applicable, a description of any modifications to the plan.

    (f)

    Inspection report forwarded to the district. Within 30 days after the completion of any work requiring a permit under this title, the Department shall forward a final inspection report to the District.
