SubTitle 1. IN GENERAL |
§ 33-5-110. WATERCOURSES, WETLAND AREAS, BUFFERS, HABITAT PROTECTION AREAS, FLOODPLAINS, AND FOREST BUFFERS.
(a)
Restoration required. The owner of a property on which any clearing, filling, or grading activity is undertaken in a watercourse, wetland area, floodplain, buffer, habitat protection area, or forest buffer in violation of the provisions of this title shall, on notification, restore the areas in accordance with the requirements of the Department of Environmental Protection and Sustainability.
(b)
Penalty. A person who does not comply with the restoration requirements of the Department of Environmental Protection and Sustainability is subject to the action as provided for in Subtitle 3 of this title.
