§ 32-8-305. CONDITIONS.

(a)

Authorized. Conditions may be attached to the waiver action.

(b)

Required notification. For any waiver issued, a letter shall be sent to the applicant indicating the terms and conditions of the waiver, the increased risk to life and property in granting the waiver, and the increased premium rates for national flood insurance coverage.

(c)

Requirement for recordation.

(1)

The applicant shall be notified in writing of the requirement:

(i)

For recordation of the conditions of a waiver on the deed or memorandum of land restriction before obtaining a permit; and

(ii)

To secure all necessary permits as a condition for granting a waiver.

(2)

The memorandum is described in §§ 3-102 and 3-103 of the Real Property Article of the Annotated Code of Maryland.
