§ 32-4-503. INITIAL REVIEW AND APPROVAL OF PLAN.
(a)
Referral to DEPS. Upon receipt of a reclamation plan, the Director of Planning shall refer the plan to the Department of Environmental Protection and Sustainability for review and comments.
(b)
Response to Director of Planning. The Department of Environmental Protection and Sustainability shall submit its comments to the Director of Planning within 30 days after receiving the plan.
(c)
Action by Director of Planning. After reviewing the comments and the reclamation plan for compliance with this subtitle:
(1)
If the reclamation plan is in compliance, the Director of Planning shall:
(i)
Accept the reclamation plan; and
(ii)
Within 20 days after receiving the reclamation plan from the Department of Environmental Protection and Sustainability, transmit the reclamation plan to the Planning Board for action as provided under this subtitle; or
(2)
If the reclamation plan is not in compliance, the Director of Planning shall return the plan to the applicant with an explanation for its return.
