§ 32-4-108. PROHIBITION ON TRANSFER OF LAND.

  • (a)

    In general. A person may not convey a lot, parcel, or tract of a subdivision unless a plat, if required, has been recorded in accordance with this title and the plat is effective at the time of the conveyance.

    (b)

    Enforcement. The transferee of a lot, parcel, or tract conveyed in violation of this section may bring an action in the Circuit Court

    (1)

    Rescind the conveyance and obtain return of the deposit or purchase money paid; and

    (2)

    Receive reimbursement for reasonable expenses, including attorney's fees, incurred in connection with the conveyance.
