SubTitle 1. IN GENERAL |
§ 32-3-107. SAME - CONTENTS OF FILES; EXPLANATION OF DECISION.
(a)
Contents of files. The Zoning Commissioner shall:
(1)
Maintain a complete file of each hearing on a petition that the zoning commissioner presides over; and
(2)
Include at least the following documents in the hearing file:
(i)
The petition;
(ii)
A report or comments from:
1.
The Planning Board;
2.
The Director of Planning or a designee; or
3.
Any other county agency;
(iii)
Any exhibits accepted as evidence at the hearing; and
(iv)
The opinion rendered by the Zoning Commissioner.
(b)
Explanation of decision required. When rendering a decision, the Zoning Commissioner shall fully explain the basis for the decision.
