§ 32-2-302. REFERRAL TO OTHER AGENCY; RECOMMENDATION TO THE COUNTY COUNCIL.

  • (a)

    Referral to other agency. At the next meeting after receiving a report by the Director of Planning under § 32-2-301 of this subtitle, the Planning Board shall, by resolution, direct the Director of Planning to refer the question to the county agency and, if applicable, the Board of Education, most nearly affected by or concerned with the proposal for the public improvement or facility.

    (b)

    Report by agency to planning board and county council.

    (1)

    The county agency receiving a referral under subsection (a) of this section shall have 30 days after the date of receipt of the referral to recommend to the Planning Board and the County Council whether or not it would be in the public interest to reserve any portion or all of the land involved in the application for a building permit or for approval of a Development Plan.

    (2)

    The agency's recommendation, if affirmative, shall include:

    (i)

    A report;

    (ii)

    A map showing the boundaries and area of the parcel to be reserved; and

    (iii)

    An estimate of the time required to complete the acquisition of the land involved in the application, provided the amount of time does not exceed 18 months after the application was filed.

    (c)

    Recommendations by Planning Board to County Council. The Planning Board shall have a period of 30 days after the date of the agency's report to submit its recommendations to the County Council for their consideration.
