§ 32-2-303. AUTHORITY OF COUNTY COUNCIL TO IMPOSE PUBLIC RESERVATION.
(a)
Resolution required.
(1)
The County Council may pass a resolution imposing the reservation and describing the land to be reserved.
(2)
The County Council's resolution may not occur until after the earlier of:
(i)
The receipt of the Planning Board's recommendations; or
(ii)
30 days after the date the County Council received the county agency's report.
(b)
Failure to pass resolution. Failure by the County Council to pass a resolution within 90 days after the date of the county agency's report and recommendation shall:
(1)
Terminate the procedure under this subtitle; and
(2)
Prevent any or all of the land described in the county agency's report and recommendation from being subject to the procedures of this subtitle for a period of 2 years after the date the county agency's report and recommendation was received by the County Council.
