§ 25-3-301. PRINCIPAL OFFICE; BOOKS AND RECORDS.

  • (a)

    Principal office.

    (1)

    While a franchisee operates a cable system in the county, the franchisee shall maintain its principal office in the county.

    (2)

    The principal office shall serve as the place where all legal notices, directions, orders, and requests may be served or delivered to the franchisee in accordance with this article.

    (3)

    The franchisee shall immediately notify the County Council of the location of the principal office or of any change in the location of the principal office.

    (b)

    Books and records; duty of franchise; access by county.

    (1)

    A franchise shall:

    (i)

    Keep complete and accurate books of accounts and records of its business and operation in the county; and

    (ii)

    Maintain the books of accounts and records at the franchisee's principal office in the county.

    (2)

    (i)

    The County Council, the county, or the county's authorized representatives shall have access to all of the books of accounts and records required under paragraph (1) of this subsection.

    (ii)

    On receipt of 48 hours notice in advance, the franchisee shall provide access to the books of accounts and records between the hours of 9:00 a.m. and 5:00 p.m.

    (3)

    A franchisee that knowingly makes a false entry in the franchisee's books of accounts and records relating to a material and substantial fact is deemed to have committed a violation of a material provision of this article.
