§ 21-4-206. LICENSE SUSPENSION, REVOCATION, OR NONRENEWAL - AUTHORITY OF THE DIRECTOR.

  • (a)

    Causes for suspension, revocation or nonrenewal enumerated. The Director may suspend, revoke, or refuse to renew a license issued under this subtitle if the licensee has:

    (1)

    Made a false or misleading statement in an application or other document required to be filed under this subtitle;

    (2)

    Allowed the improper use of a license by a person, including the selling or lending of a license;

    (3)

    Allowed the public to operate a coin-operated amusement device that is not properly licensed;

    (4)

    Failed to pay the proper taxes due in a timely manner on a coin-operated amusement device subject to taxation by either local or state ordinance;

    (5)

    Failed to maintain a licensed coin-operated amusement device in proper physical and mechanical condition;

    (6)

    Failed to properly supervise the premises or individuals using the premises where a licensed coin-operated amusement device is maintained and operated including:

    (i)

    The failure to prevent individuals on the licensee's premises from wilfully obstructing or hindering the passage of the public through the premises;

    (ii)

    The failure to prevent individuals on the licensee's premises from disturbing the peace of the surrounding neighborhood by loud noises or by the use of profanity or obscene language within the hearing of individuals in, near, or on the premises;

    (iii)

    The failure to prevent individuals from gambling on the premises; or

    (iv)

    The failure to prevent individuals on the premises from acting in a disorderly manner or in disturbance of the public peace; or

    (7)

    Violated a provision of this subtitle or a regulation adopted in accordance with this subtitle.

    (b)

    Just cause. In addition to the causes enumerated in subsection (a) of this section, the Director may suspend, revoke, or refuse to renew a license issued under this subtitle for just cause.
