§ 21-13-102. QUALIFICATIONS.
(a)
Insurance.
(1)
The Director shall require each applicant for a license to furnish proof of financial responsibility in the form of a written certificate from an insurance carrier authorized to transact business in the state.
(2)
The certificate shall state that the applicant is insured against liability for damage including death or injury to persons and damage to property due to faulty equipment or negligence and indemnifying the county against any suit or suits, losses, claims, damages, or expense to which the county may be subjected by reason of any damage to property or person, including death or injury, to the public highways and other public property done in or in connection with the transportation, erection, operation, maintenance, and supervision of the ride or riding device mounted on mobile equipment.
(3)
The certificate shall be provided in an amount which in the discretion of the Director will adequately protect the public.
(b)
Nonresident - Power of attorney. If the applicant for a license is a nonresident of the state, the applicant and the applicant's insurance carrier shall execute a power-of-attorney authorizing the Director to accept service on their behalf of notices, processes, and any action arising out of the ownership, operation, maintenance, or any other connection with a ride or riding device mounted on mobile equipment that is within the county.
(c)
Same - Required certificate. If a corporation that is a nonresident of the state applies for a license, the Director shall issue a license if the nonresident corporation:
(1)
Complies with all conditions contained in this title; and
(2)
Submits with its application for a license a certificate from the state Department of Assessments and Taxation certifying that the nonresident corporation is a duly constituted corporation authorized to do business in the state.
