§ 20-5-114. INDUSTRIAL WASTEWATER DISCHARGE PERMITS.

  • (a)

    Required. No person may discharge any industrial wastewater into the system unless such person has obtained an industrial wastewater discharge permit.

    (b)

    Existing users. All existing users discharging industrial wastewater to the system shall apply for an industrial wastewater discharge permit within ninety (90) days after the effective date of this title. This deadline may be extended by the Engineer for good cause shown.

    (c)

    Waste haulers. All waste haulers shall be considered dischargers of industrial wastewater and shall be subject to the provisions of this title. The Engineer may differentiate the form of the wastewater discharge permit applicable to waste haulers from that applicable to other dischargers of industrial wastewater. Costs considered for determination of permit fees may include such additional costs, beyond those included for other discharges of industrial wastewater, as found appropriate by the Engineer. The Engineer is authorized to require as a permit condition the display of vehicle permit tags on all vehicles transporting wastewater within the county and to establish application procedures and a fee for said tags, such fee to include but not be limited to the costs of permitting and inspecting waste hauler vehicles.

    (d)

    Fees. A schedule of annual wastewater discharge permit fees may be established by the County Administrative Officer. Such fees shall be based on the county's costs of operating the industrial waste and pretreatment programs, including but not limited to the costs of issuing permits, inspection of facilities, sampling and analysis of wastewater, and enforcement of pretreatment requirements.

    (e)

    Application. Users required to obtain an industrial wastewater discharge permit shall complete and file with the Department of Permits and Development Management an application in the form prescribed by the Engineer, and accompanied by the permit fee set by the County Administrative Officer. Proposed new users shall apply at least ninety (90) days prior to connecting to the system. In support of the application, the user shall submit, in units and terms appropriate for evaluation, the following information:

    (1)

    Name and address of property owner and user and the address of the property from which the industrial wastewater is being discharged;

    (2)

    User's SIC number according to the Standard Industrial Classification Manual, Bureau of the Budget, 1972, as amended;

    (3)

    Time and duration of wastewater discharge;

    (4)

    Average daily and three-minute peak wastewater flow rates, including daily, monthly, and seasonal variations, if any;

    (5)

    Site plans, floor plans, mechanical and plumbing plans, and details to show all sewers, sewer connections, and appurtenances by the size, location, and elevation, where available;

    (6)

    Description of activities, facilities, and plant processes on the premises, including all materials which are or could be discharged;

    (7)

    The nature and concentration of any pollutants in the discharge which are limited by any county, state, or federal discharge standards, and a statement indicating whether or not the discharge standards are being met on a consistent basis and, if not, whether pretreatment is required for the user to meet applicable discharge standards;

    (8)

    If additional pretreatment or additional or alternative manufacturing, processing, housekeeping procedures, or operation and maintenance procedures will be required to meet discharge standards, the user will provide the shortest schedule for compliance; the completion date in this schedule must be approved by the Engineer and shall not be later than the compliance date established by any applicable national categorical pretreatment standard; the conditions contained in § 20-5-118 of this title shall apply to this schedule;

    (9)

    Each product produced by type, amount, process or processes, and rate of production;

    (10)

    Type and amount of raw materials processed (average and maximum per days);

    (11)

    Number of employees and hours of operation;

    (12)

    Any other information as may be deemed by the Engineer to be necessary to evaluate the permit application; and

    (13)

    Consent to inspection and monitoring of user facilities and to sample and meter wastewater on request.
