§ 19-3-106. TERM AND RENEWAL OF PERMIT; REINSTATEMENT.

  • (a)

    Term of permit. Unless a permit is renewed for a 1-year term as provided in this section, the permit expires on the first anniversary of its effective date.

    (b)

    Applications for renewal. Before a permit expires, the permit holder periodically may renew it for an additional 1-year term if the permit holder:

    (1)

    Otherwise is entitled to receive a permit;

    (2)

    Pays to the Department a renewal fee;

    (3)

    Submits to the Department:

    (i)

    A renewal application on the form that the Department provides; and

    (ii)

    Satisfactory evidence of compliance with the requirements of this title, the regulations, and the requirements set under this section for permit renewal.

    (c)

    Issuance of renewal. The Department shall renew the permit of each permit holder who meets the requirements of this title.

    (d)

    Reinstatement of expired permits. The Department shall reinstate the permit to a person who has failed to renew the permit for any reason if the person:

    (1)

    Meets the renewal requirements of this section;

    (2)

    Pays to the Department a reinstatement fee; and

    (3)

    Submits to the Department satisfactory evidence of compliance with the requirements of this title, the regulations, and the requirements set under this section for permit renewal.
