§ 19-1-303. CONDITIONS OF SERVICE.

  • (a)

    Immunities. An auxiliary police officer shall have and enjoy all the immunities of defense available to sheriffs, constables, police, and peace officers in any suit, civil or criminal, brought against the officer in consequence of acts or omissions done in the course of the officer's duties as a member of the auxiliary police team.

    (b)

    Reimbursement of legal expenses. If criminal prosecution is instituted or a civil action is filed against an auxiliary police officer for an act or omission that was committed in the scope and during the course of the auxiliary police officer's assigned volunteer duties, the county shall supply defense and reimbursement of the auxiliary police officer for expenses incurred in accordance with Article 4 of the Code.
