§ 17-4-106. CERTIFICATION OF COMPLIANCE.

  • (a)

    Certification. Subject to subsection (b) of this section, not later than December 31, 2006, the owner, manager, or operator of a shopping center subject to the provisions of this title shall submit a certification that the shopping center is in compliance with the provisions of this title.

    (b)

    Signature. The certification required under subsection (a) of this section shall be signed by a Maryland licensed architect, engineer or surveyor and shall at a minimum include the date that the certifying professional examined the property in order to make the determination required under subsection (a) of this section.

    (c)

    Recertification. After submitting the certification required under subsection (a) of this section to the Department of Permits, Approvals and Inspections, the owner, manager, or operator of a shopping center shall be required to submit a recertification only on request of the Director or if a change occurs in the information that was previously certified. If a recertification is required as a result of a change, it shall be filed within 60 days after the change unless an extension is granted for good cause shown.

    (d)

    Adequacy. The Director of Permits, Approvals and Inspections shall have sole discretion to determine the adequacy of a certification filed under this section.

    Section 3 of Bill No. 23-06 provides that the owner, manager, or operator of any shopping center that was not subject to the requirements of Section 2 of Bill 21-05 but which is subject to Article 17, Title 4 of the Baltimore County Code, 2003 as of the effective date of this Act shall comply with the requirements of Article 17, Title 4 of the Baltimore County Code, 2003 by December 31, 2006. The owner, manager, or operator of a shopping center that becomes subject to Article 17, Title 4 after December 31, 2006 shall comply with its requirements within 60 days unless an extension is granted for good cause shown.
