§ 17-1-115. PICKETING AT FUNERALS.

  • (a)

    Definitions.

    (1)

    In this section, the following words have the meanings indicated.

    (2)

    "Funeral" means any ceremony, procession or memorial service in connection with the death of a person.

    (3)

    "Picketing" means any form of protest march or protest activity engaged in by a person within 300 feet of any entrance to a cemetery, mortuary, church or other location where a funeral is held or conducted.

    (b)

    Prohibited . A person may not:

    (1)

    Engage in picketing within one hour prior to, during and two hours following the commencement of a funeral, except on public streets, public sidewalks or other public spaces; or

    (2)

    Obstruct or prevent the intended uses of a public street, public sidewalk or other public space while engaged in picketing.

    (c)

    Penalty . A person who violates this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 or imprisonment not exceeding 6 months or both.
