§ 17-1-109. PRESSURIZED SPRAY PAINT CAN.

  • (a)

    Prohibition - Possession. A person may not possess a pressurized spray paint can with the intent to deface, injure, damage, or in any other manner unlawfully apply paint to:

    (1)

    Public property; or

    (2)

    Another person's personal or real property without the consent of the owner of the property.

    (b)

    Same - Sale, etc. A person may not sell, exchange, give, or loan a pressurized spray paint can to a person if the sale, gift, or loan is with the intent to induce the use of, or with knowledge that the person will use the pressurized spray paint can in a manner that is prohibited under subsection (a) of this section.

    (c)

    Penalty. A person who violates this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 or imprisonment not exceeding 90 days or both.
