Article 14. FIRE PROTECTION |
Title 2. FIRE PREVENTION CODE, RULES, AND REGULATIONS |
SubTitle 1. IN GENERAL |
§ 14-2-101. AUTHORITY TO ADOPT.
(a)
Authority of the county. The county may adopt and amend by resolution or ordinance a Fire Prevention Code that includes provisions for:
(1)
Protection against fires;
(2)
Prevention, abatement, and removal of fire and life hazards;
(3)
Additional powers and duties of the Office of the Fire Marshal;
(4)
The incorporation by reference into the Fire Prevention Code of a code or part of a code prepared by a governmental agency or a trade or professional association for general distribution in printed form as a standard or model on any subject relating to fire prevention, fire hazards, flammable substances, hazardous materials, or hazardous processes;
(5)
The procedures for the enforcement of the Fire Prevention Code; and
(6)
The penalties for the violation of:
(i)
The Fire Prevention Code; or
(ii)
An order issued under the authority of:
1.
The Fire Prevention Code; or
2.
An ordinance, resolution, or regulation for:
A.
The prevention of fires; or
B.
The prevention, abatement, or removal of fire hazards.
(b)
Revision of incorporated code. Subsequent amendments to a model or standard code adopted in accordance with subsection (a)(4) of this section are not effective until the revisions are specifically incorporated by the county into the county Fire Prevention Code.
(c)
Authority of the Fire Chief. The Fire Chief may adopt all necessary rules and regulations with respect to fire prevention and fire inspections in the county.
