§ 13-6-203. PERMIT TO OPERATE AND MAINTAIN REQUIRED.

  • (a)

    In general. A person may not operate or maintain a public swimming pool or public bathing beach unless the person has obtained, in accordance with the approval of the Department of Health, a permit to operate a public swimming pool or public bathing beach from the Department of Permits, Approvals and Inspections.

    (b)

    Qualifications. A person may receive and retain a permit under this section only if the person complies with this subtitle.

    (c)

    Date and duration. A permit shall be obtained by May 1 and shall be valid for 1 year unless the permit is revoked.

    (d)

    Non-transferable. A permit issued under this section is not transferable.

    (e)

    Suspension and revocation.

    (1)

    The Department of Health may recommend suspension or revocation of a permit because of the permit holder's failure to comply with proper operational procedures as set forth in regulations adopted by the Health Officer.

    (2)

    The Department of Permits, Approvals and Inspections shall suspend or revoke the permit on recommendation of the approving authority.
