§ 13-6-202. CONSTRUCTION, ALTERATION, OR RENOVATION OF A SWIMMING POOL.

  • (a)

    In general.

    (1)

    A person may not begin construction of or substantial alteration or reconstruction of any public swimming pool or public bathing beach without first submitting plans and specifications to the Department of Health for review and approval.

    (2)

    The plans shall be prepared and copies submitted to the Department of Health for review and approval within a reasonable time.

    (b)

    Standards for review and approval.

    (1)

    The Department of Health shall review plans in accordance with the standards set forth in regulations adopted by the Health Officer.

    (2)

    The regulations are adopted and incorporated by reference in this subsection as if fully set forth.

    (c)

    Permit application. If a building permit is required, the applicant for a permit shall submit an application on forms required by the Department of Permits, Approvals and Inspections together with any supporting data required for the proper review of the plans.

    (d)

    Approval of all departments required. The Department of Permits, Approvals and Inspections may not issue a permit under this section until approval is granted by all departments involved.

    (e)

    Construction. Unless changes have been submitted in writing to and approved by the Department of Health, the public swimming pool or public bathing beach facilities shall be built in accordance with the plans as approved.

    (f)

    Operation. A public swimming pool or public bathing beach may not be placed in operation until the public swimming pool or public bathing beach is in compliance with the requirements of this subtitle.
