§ 13-4-202. SAME - OCCUPANT AND OWNER RESPONSIBILITIES.

  • (a)

    In general.

    (1)

    The occupant of a premises, whether the occupant is the owner or not, is responsible for the sanitary condition of the premises occupied.

    (2)

    If a property is occupied by a tenant:

    (i)

    The tenant is responsible for the property assigned to the tenant; and

    (ii)

    The owner is responsible for the portions of the property not leased to the tenant.

    (b)

    Placement of solid waste prohibited. Except as provided in this subtitle, a person may not place or deposit solid waste or allow solid waste to be placed or deposited on an occupant's premises, with or without the consent of the occupant or owner.
