§ 10-2-404. SAME - UNIFORM BIDDING.

  • (a)

    In general. The Purchasing Agent shall discourage uniform bidding by every possible means and endeavor to obtain as full and open competition as possible on all purchases and sales under this subtitle.

    (b)

    Required statement. The Purchasing Agent shall require each bidder to include with the bid a statement made under oath that the bidder has not participated with other bidders in an agreement to bid a fixed or uniform price.

    (c)

    Violation.

    (1)

    A violation of the statement required under subsection (b) of this section shall render void the bids of all bidders involved in the prohibited practice.

    (2)

    Any disclosure to or acquisition by a competitive bidder, in advance of the opening of the bids, of the terms or conditions of the bid submitted by another competitor shall render the bid of the bidder or bidders void.
