§ 7-1-408. REQUEST FOR ASSISTANCE AND ADVICE.

  • (a)

    Authorized. A person who is or may be subject to this subtitle may seek the assistance and advice of the Executive Director:

    (1)

    To determine whether disclosure is required; and

    (2)

    In the preparation of the required forms.

    (b)

    Process. The person requesting assistance shall:

    (1)

    Make the request in writing;

    (2)

    Meet in person with the executive director to answer questions regarding a required disclosure; and

    (3)

    Provide to the Executive Director original documents or records which the Executive Director considers pertinent to the request for assistance.

    (c)

    Executive Director to prepare report. At the conclusion of the review of the request for assistance, the Executive Director shall prepare a written report to the Commission with recommendations regarding the request.

    (d)

    Commission to issue an opinion. The Commission shall review the Executive Director's report and issue a written opinion regarding the request for assistance.

    (e)

    Legal effect of the Commission's opinion. The Commission's opinion is binding on the Commission in any subsequent investigation or complaint proceeding concerning the person who requested assistance and who acts in reliance on the opinion in good faith, unless the person omitted or misstated material facts concerning the matter for which the person requested assistance.
