§ 7-1-402. SAME - CANDIDATES.
(a)
In general.
(1)
Except as provided in subsection (b) of this section, each candidate for election to an office as an elected official shall file a financial disclosure statement at the same time the candidate files a certificate of candidacy.
(2)
The financial disclosure statement filed with a certificate of candidacy shall cover the preceding year.
(3)
(i)
If the candidate files the certificate of candidacy before January 1 of the year in which the election is held, on or before the last day for the withdrawal of candidacy, the candidate shall file a supplementary financial disclosure statement for the year immediately preceding the election.
(ii)
If, after written notice provided at least 20 days before the last day for the withdrawal of candidacy, the candidate fails to file a supplementary financial disclosure statement before or on the last day for the withdrawal of candidacy, the candidate is deemed to have withdrawn the candidate's candidacy.
(b)
Exception; financial disclosure already filed. If the candidate is a public official who has already filed a financial disclosure statement under this subtitle covering the year preceding the election, the candidate is not required to file a financial disclosure statement at the time the candidate files a certificate of candidacy or nomination.
(c)
Technical requirements. A candidate shall file a financial disclosure statement or a supplementary financial disclosure statement:
(1)
With the Board of Election Supervisors; and
(2)
Under oath or affirmation.
(d)
Acceptance of certificate of candidacy. The Board of Election Supervisors may not accept a certificate of candidacy unless the candidate has filed the financial disclosure statement in proper form.
(e)
Duty to forward financial disclosure statement. Within 30 days after receipt of the financial disclosure statement, the Board of Election Supervisors shall forward the statement to the Commission or an office designated by the Commission.
