§ 7-1-401. FILING OF FINANCIAL DISCLOSURE STATEMENTS REQUIRED - IN GENERAL.

  • (a)

    Required to file. The following public officials shall file the financial disclosure statements required under this subtitle:

    (1)

    Each public official required to complete the training required under § 7-1-203 of this title;

    (2)

    The chairman and members of the County Council;

    (3)

    The County Attorney, the Deputy County Attorney, and an Acting County Attorney or Acting Deputy County Attorney;

    (4)

    The administrative assistant to the County Council;

    (5)

    The Administrative Law Judges of the Office of Administrative Hearings;

    (6)

    Deputy department heads, and acting department heads and deputy department heads;

    (7)

    Deputy office heads, and acting office heads and deputies;

    (8)

    The chairman and members of the Board of Recreation and Parks;

    (9)

    The chairman and members of the Electrical Administrative Board;

    (10)

    The chairman and members of the Plumbing Board;

    (11)

    The chairman and members of the Board of Health;

    (12)

    The chairman and members of the Board of Library Trustees;

    (13)

    The Executive Director and staff of the Office of Ethics and Accountability;

    (14)

    The paid and unpaid members of boards of all state agencies funded in whole or in part by the county;

    (15)

    The chairman and members of the Agricultural Land Preservation Advisory Board;

    (16)

    The chairman and members of the Workforce Development Council;

    (17)

    The chairman and members of the Telecommunications Advisory Panel; and

    (18)

    Subject to subsection (f)(2) of this section, the chairman and members of the Board of Trustees of the Community College of Baltimore County.

    (b)

    Appointed public official. A public official who has not filed a financial disclosure statement and who is appointed to fill a vacancy for a position under subsection (a) of this section shall, within 30 days after the appointment, file a financial disclosure statement covering the calendar year preceding the appointment.

    (c)

    Not required to file. An official or employee of the state not specifically listed in this section is not required to file the financial disclosure statement required under this subtitle.

    (d)

    Technical requirements. The public official shall file the required financial disclosure statement:

    (1)

    With the Commission

    (2)

    Under oath or affirmation;

    (3)

    Except as required in subsections (b) and (e) of this section and § 7-1-403(i)(3) of this subtitle, on or before April 30 of each year during the public official's term in office or during the public official's employment by the county; and

    (4)

    For the year immediately preceding each year in office or employment by the county.

    (e)

    Filing of statement by former employees.

    (1)

    Except as provided under paragraph (3) of this subsection, an individual who, other than by reason of death, leaves an office or employment for which a statement is required by this subtitle shall file the statement within 60 days after leaving the office or employment.

    (2)

    The statement shall cover:

    (i)

    The calendar year immediately preceding the year in which the individual left office or employment, unless a statement covering that year has already been filed by the individual; and

    (ii)

    The portion of the current calendar year during which the individual held the office or employment.

    (3)

    This subsection does not require the filing of a statement if:

    (i)

    The individual has left office or employment to become an official or employee in another office for which a statement is required under this subtitle; and

    (ii)

    The disclosure requirements of the new office are at least as extensive as those of the old office or employment.

    (f)

    Board and commission members.

    (1)

    Subject to paragraph (2) of this section, for members of boards and commissions listed in subsection (a) of this section who do not receive compensation for service on the board or commission, the Commission shall authorize disclosure similar to that allowed under § 5-609 of the General Provisions Article of the Annotated Code of Maryland.

    (2)

    The chairman and members of the Board of Trustees of the Community College of Baltimore County may file with the Commission a copy of their financial disclosure statement filed under Title 5 of the General Provisions Article of the Annotated Code of Maryland.

    (g)

    Filing electronically. The Commission may develop procedures under which financial disclosure statements may be filed electronically without additional cost to the individual who files the statement.
