§ 5-1-205. SAME—WHEN MEMBERSHIP CEASES.

  • Should any member in any period of six (6) consecutive years after last becoming a member be absent from service more than two (2) years or should the member withdraw his or her accumulated contributions or should the member become a beneficiary as a consequence of the member's service to the county or die, the member shall thereupon cease to be a member. However, when any such person (other than one who has become a beneficiary or died) has withdrawn his or her accumulated contributions and has later returned to service, he or she may subsequently redeposit in the Retirement System the amount of accumulated contributions previously withdrawn, with interest to the date of redeposit, and regain previous service credit with the condition; however, he or she may not retire for service or for ordinary disability within three (3) years after the date of reentry in the Retirement System. Retirement for accidental disability within such three-year period after the date of reentry will not cause a forfeiture of such previous service credit. Notwithstanding the foregoing, the Board of Trustees shall continue the membership of any member entering directly into the armed forces of the United States who does not withdraw his or her accumulated contributions for the period of service in the armed forces and for not more than one (1) year following his or her honorable discharge therefrom.
