§ 4-5-312. SAME - MEMORANDUM OF UNDERSTANDING.
(a)
Required. When the county administration and the exclusive representative in a representation unit reach an agreement on matters relating to wages, hours, and terms and conditions of employment, the items agreed to shall be included in a memorandum of understanding.
(b)
Effect of failure to pass legislation. Failure of the County Council to provide funds or pass legislation necessary to implement any part of a memorandum of understanding does not vitiate the mutual obligation of either party to the agreement to continue negotiations, if either party requests that negotiations continue.
(c)
Effect of decertification. If a memorandum of understanding is in effect on the effective date of the decertification of an exclusive representative which is a party to the memorandum of understanding, the county administration and any newly certified exclusive representatives are bound by the provisions of that agreement during the remainder of the term of that agreement.
