§ 4-5-309. DUES DEDUCTION.

  • (a)

    In general. An employee organization officially certified as the exclusive representative for a representation unit in accordance with this act is the only employee organization entitled to membership dues deduction privileges.

    (b)

    Deductions not allowed. Except as provided in subsection (e) of this section, notwithstanding subsection (a) of this section, exclusive representative membership dues may not be deducted on behalf of an employee whose position is not included in a representation unit.

    (c)

    Conditions. A dues deduction authorization is irrevocable for a period of 1 year and automatically renewable from year to year thereafter unless the employee gives the employer written notice of termination of the dues deduction at least 30 days before the anniversary of the date on which dues deduction began.

    (d)

    Privilege ends at decertification. The dues deduction privilege ceases if the exclusive representative is decertified.

    (e)

    Privilege extended for certain personnel. A Battalion Fire Chief, or above, or a Police Captain, or above, who has exercised dues deductions privileges by the county as of January 1, 1977, may continue to receive the privilege until the individual requests that the deductions be terminated.
