§ 4-5-304. REQUIREMENTS FOR A PETITION FOR CERTIFICATION.
(a)
When to submit. The Director of Human Resources may accept a petition only during the month of September.
(b)
Content - Request for certification. A petition filed by an employee organization for certification as an exclusive representative shall contain:
(1)
A request that the county administration recognize the employee organization as the exclusive representative of the employees in one of the representation units; and
(2)
A statement that the employee organization has in its possession written proof dated not more than 6 months before the day on which the petition is filed to establish that at least 30% of the employees in the representation unit have designated the employee organization to represent them in their employment relations with the county.
(c)
Information required. An employee organization that seeks certification as an exclusive representative for a representation unit shall file with the Director of Human Resources the following information and documents:
(1)
A statement that the employee organization is one in which employees participate and that has as one of its purposes the representation of public employees in matters of wages, hours, and other terms and conditions of employment; and
(2)
A statement that the employee organization has no terms or conditions of membership which discriminate with regard to race, color, creed, gender, age, political affiliation, national origin, religion, marital status, or disability.
(d)
Same - Request for decertification. A petition filed with the Director of Human Resources by an employee or employees in a representation unit or an employee organization seeking to decertify the current exclusive representative shall be accompanied by substantive documentary proof, dated not more than 6 months before the day on which the petition is filed, that at least 30% of the employees within the representation unit approve of the decertification of the exclusive representative.
