§ 4-5-302. REPRESENTATION UNITS.
(a)
"Employee" defined. Notwithstanding the definition of "employee" in § 4-5-101 of this title, in this section, "employee" includes:
(1)
Part-time registered nurses employed by the county, notwithstanding that part-time nurses are not members of the classified service; and
(2)
Individuals whose positions are referenced in:
(i)
Subsection (d) of this section; or
(ii)
Pay schedule I of the County Classification and Compensation Plan.
(b)
Exception. This section does not apply to confidential, management, or, except as provided in subsection (a)(2) of this section, supervisory employees.
(c)
In general. All employees within each of the following categories shall constitute a separate representation unit:
(1)
All salaried employees in pay schedule I of the County Classification and Compensation Plans;
(2)
All hourly paid employees in pay schedule II of the County Classification and Compensation Plans;
(3)
All uniformed classes of the Police Department in pay schedule IV of the County Classification and Compensation Plans;
(4)
All uniformed classes of the Fire Department in pay schedule V of the County Classification and Compensation Plans;
(5)
All registered nurses in pay schedule III of the County Classification and Compensation Plans; and
(6)
All deputy sheriffs in pay schedule XIII of the County Classification and Compensation Plans who have taken and subscribed the oath provided in § 2-104 of the Courts Article of the Annotated Code of Maryland.
(d)
Fire and police.
(1)
All ranks of Fire Captain and below in the Fire Department and Lieutenant and below in the Police Department shall be in the respective police or fire uniformed classes representation unit.
(2)
All other ranks above Fire Captain and Lieutenant shall have their representation status determined in accordance with the provisions of this Act.
(e)
Law enforcement. Notwithstanding any other provisions of this subtitle, an employee organization may not represent or be certified as the exclusive representative of employees in any unit of law enforcement employees if the employee organization admits to membership or is affiliated directly or indirectly with any employee organization or other labor organization that admits to membership employees or other individuals employed in any capacity other than as law enforcement employees.
