§ 3-9-202. TERMS.
(a)
Duration. The initial term of a franchise granted under this subtitle may not exceed 35 years.
(b)
Renewal.
(1)
At the option of the county, a franchise may be renewed for successive terms of not more than 25 years each.
(2)
(i)
Each renewal shall be based on a fair revaluation of the franchise.
(ii)
A revaluation of the franchise shall take into account any value derived from the franchise.
(c)
Other terms. The grant of a franchise shall contain provisions:
(1)
Securing efficiency of public service at reasonable rates;
(2)
Securing maintenance of the property in good condition throughout the term of the franchise;
(3)
Specifying the mode of determining valuation and revaluation of compensation which may be provided for in the franchise;
(4)
Regarding termination of the franchise and other remedies for failure of compliance with the terms of the franchise;
(5)
Specifying the time periods for the exercise of remedies under the franchise resulting from the franchisee's default; and
(6)
Expressly reserving for the county administration the right and duty at all times to exercise full governmental control and regulation in respect to all matters connected with the franchise not inconsistent with the terms of the franchise.
